Alternative Dispute Resolution
1. Scope
1.1 These General Terms and Conditions (GTC) of GLOBAL SCALE HIGH LTD. (hereinafter "Seller") regulate the legal relationships between the Seller and its customers (consumers or entrepreneurs) with regard to the purchase of goods offered in the Seller's online shop. The customer's own terms and conditions are hereby excluded unless an express written agreement has been made.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for private purposes that are not related to his or her commercial or independent professional activity.
1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
2. Conclusion of contract
2.1 The product descriptions presented in the seller's online shop do not constitute binding offers, but serve as a basis for the customer to submit a binding purchase offer.
2.2 The customer can submit his offer using the order form integrated in the online shop. After the customer has placed the desired goods in the virtual shopping cart and completed the electronic ordering process, he submits a legally binding contractual offer with regard to the goods contained in the shopping cart by pressing the button that completes the ordering process.
2.3 The seller can accept the customer's offer within five days. Acceptance occurs by:
Sending a written or textual (e.g. by email or fax) order confirmation, whereby the receipt of the confirmation by the customer is decisive,
Delivery of the ordered goods, whereby the receipt of the goods by the customer is decisive,
or request for payment after placing the order.
If several of these alternatives exist, the contract is concluded at the time the first of these alternatives occurs. The acceptance period begins on the day after the customer sends the offer and ends on the fifth day. If no acceptance is made within this period, the offer is deemed to have been rejected and the customer is no longer bound by his declaration of intent.
2.4 If a PayPal payment method is selected, payment will be processed via PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal terms of use. The seller declares acceptance of the customer's offer at the moment the customer completes the order process.
2.5 If you choose Amazon Payments as your payment method, payment will be processed via Amazon Payments Europe sca, 38 avenue John F. Kennedy, L-1855 Luxembourg, subject to the Amazon Payments Europe Terms of Use. The seller declares acceptance of the customer's offer at the moment the customer completes the order process.
2.6 The contract text will be saved by the seller after conclusion of the contract and sent to the customer in text form (e.g. by email, fax or letter). The contract text will not be made available beyond this.
2.7 Before completing the order, the Customer has the opportunity to identify and correct any input errors by carefully checking the information displayed on the screen.
2.8 The contract is concluded exclusively in German.
2.9 Order processing and communication are usually carried out via email. The customer is obliged to ensure that the email address provided is correct and that emails from the seller can be received.
3. Right of withdrawal
3.1 Consumers have a right of withdrawal in accordance with the statutory provisions.
3.2 Further information on the right of withdrawal, including the withdrawal period and the modalities, can be found in the seller's cancellation policy.
4. Prices and payment terms
4.1 The prices stated are total prices including statutory VAT. Any delivery and shipping costs incurred are shown separately.
4.2 For deliveries to countries outside the European Union, additional costs (e.g. customs duties, import taxes or transfer fees) may arise, which must be borne by the customer.
4.3 The available payment options are displayed in the Seller’s online shop.
4.4 If advance payment by bank transfer is agreed, payment is due immediately after conclusion of the contract, unless a later due date has been agreed.
4.5 When paying via PayPal, payment is processed in accordance with the PayPal terms of use. The seller reserves the right to reject the selected payment method in the event of a negative credit check result.
4.6 When paying via SOFORT, payment processing is carried out by SOFORT GmbH, Theresienhöhe 12, 80339 Munich. The customer requires an activated online banking account.
4.7 When paying via Shopify Payments, payment processing is carried out via Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland.
4.8 When paying via Klarna, payment processing is carried out by Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden.
5. Delivery and shipping conditions
5.1 Delivery will be made within the specified delivery area to the delivery address specified by the customer.
5.2 If delivery fails for reasons for which the customer is responsible, the customer shall bear the resulting costs.
5.3 For businesses, the risk of accidental loss or deterioration of the goods passes to the customer when the goods are handed over to the forwarding agent or carrier. For consumers, the risk generally only passes to the customer when the goods are handed over to the customer.
5.4 The seller reserves the right to withdraw from the contract in the event of unavailability of the goods. In this case, the customer will be informed immediately and will receive a refund.
5.5 It is not possible to collect the goods yourself.
6. Retention of title
The seller reserves ownership of the delivered goods until the purchase price has been paid in full.
7. Liability for defects (warranty)
7.1 The statutory provisions on liability for defects apply.
7.2 For entrepreneurs, the limitation period for claims for defects in new goods is one year from delivery. Claims for defects in used goods are excluded.
7.3 The limitations of liability do not apply to claims for damages, fraudulently concealed defects or the use of the goods for a building.
7.4 For merchants, the commercial obligation to inspect and give notice of defects pursuant to Section 377 of the German Commercial Code (HGB) remains unaffected.
7.5 Consumers are requested to immediately report any transport damage to the deliverer and to inform the seller.
8. Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies to the extent that the protection is not restricted by mandatory provisions of the law of the state in which the consumer has his or her habitual residence.
9. Alternative dispute resolution
9.1 The EU Commission provides a platform for online dispute resolution (ODR platform) at https://ec.europa.eu/consumers/odr.
9.2 The Seller is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
